Standard Business Terms

(The following Standard Business Terms include legal information regarding your rights according to the Distance Selling Act and E-Commerce).

 

§ 1 Scope

These Standard Business Terms apply to all deliveries from WOODLINK to customers (§ 13 BGB).

 


§ 2 Contracting party

The purchase agreement is concluded with Ekkehard Anders und Michael Anders, WOODLINK Ekkehard Anders GmbH & Co KG, Werner-Siemens-Straße 86, 22113 Hamburg, Germany

§ 3 Offer & contract formation

§ 3.1 The presentation of the products in the online shop is not a binding offer but an invitation to submit an offer.

 

§ 3.2 You are placing a binding order for the listed articles on the order page when clicking the button [Order]. The contract of sale comes into existence as soon as we send you a confirmation of the order by email directly after receiving your order.

 

§ 4 Right of rescission

§ 4.1 As a consumer you can cancel your contractual declaration within two weeks.

 

Cancellation Policy

 

As a consumer in terms of § 13 German Civil Code you can cancel your contractual declaration within two weeks without indicating reasons in written form (e.g. letter, fax, email) or by returning the merchandise. This time limit begins with the receipt of this policy at the earliest. The punctual dispatch of the cancellation or the merchandise suffices for ensuring the cancellation time limit. Effects of Cancellation

 

In the case of an effective cancellation mutual services are to be released. Should you not be able to release the service rendered either completely or partially or only in a declined condition you will have to render value replacement in this respect if applicable. This does not apply if the decline of the merchandise can be solely attributed to its examination as – as if it would have been possible in a store.
Furthermore you can avoid the obligation of value replacement by not using the merchandise as an owner would and by refraining from anything that affects its value. Package-transportable merchandise is to be returned. When returning merchandise with an order value below 40, - Euro you must bear the costs for return shipment if the delivered merchandise corresponds to the merchandise ordered. Otherwise return shipment is free of charge for you. Merchandise which is not package-transportable will be picked up. Financial obligations must be met within 30 days after sending this cancellation.

 

End of Policy Cancellation and Right to Return

 

§ 4.2 The right to return does not apply to goods that were produced according to customers specifications or clearly cut to the personal needs.

 
§ 4.3 Please avoid damaging or soiling. Please send the goods preferably in the original packing with all accessories. If necessary, use a protective overpack. If you don't have the original packaging anymore, please use an adequate packaging to avoid transport damages..

 

§ 4.4Please send the goods as an insured package and keep the mailing receipt. You shall have to bear the costs of return if the supplied goods are the same as the goods you have ordered. Otherwise the return shall be free of charge for you.

 

§ 4.5 Please call us at ++49(0)89-61180688 before sending the goods to announce the retourning. This helps us with allocating the products to the relevant order as fast as possible.

§ 4.6 Please notice that modalities written in the paragraphs 4.3 to 4.5 are not required for the exercise of your right of withdrawal.

 

§ 4.7 Costs agreement

If you make use of your right of rescission, you have to pay the regular cost of return if the delivered goods are adequate to the goods you have ordered and if the price of the goods, that are to return, do not exceed an amount of 40 euros or if the price of the good is higher and at the time of withdrawal you have not yet provided the consideration or a contractually agreed partial payment. Otherwise, the return is free for you.

 

§ 5 Prices and shipping costs

§ 5.1 Prices listed on the product pages include the legal value added tax as well as all other price components.

§ 5.2 In addition to the published prices we charge a flat shipping rate of Euro 6,90 for every delivery within Germany. Shipping costs to Austria is € 9,90 flat rate. For shipping to all other countries please get in touch. The cost of shipping is displayed automatically during the ordering process.

§ 6 Delivery

§ 6.1 Deliveries within Germany and European Union countries are carried out by DHL.

§ 6.2. Available items are indicated by the blue button "Order". Items that are not available are indicated by the stock notice "currently out of stock" as well as by the red button "Pre-Order".

 

§ 6.3 The delivery time for payment by direct debit or Paypal is up to 3 days. With advance payment, we are awaiting the receipt of payment. From the time of payment the delivery time is again up to 3 days. On possibly different delivery times, we point to the product page.

 

§ 6.4 Please note that we possibly have to take items, that are not available (red button with text Pre-Order), from the order. In this case, is usually no free additional delivery of non-deliverable items.

 

§ 6.5 The expected date of dispatch will be automatically calculated and displayed at the top of your shopping cart.

§ 7. Payment

§ 7.1 Payment is either via card, EC-direct debit or Paypal. Credit card payment through paypal is also possible.

 

§ 7.2 If you choose payment in advance as method of payment, we will send you our bank details in the order confirmation email and deliver the products after receiving the payment.

 

§ 8 Reservation of proprietary rights

Until full payment is received goods will remain our property.

 

§ 9 Warranty 

Warranty will be given in accordance with the statutory provisions. For all defects that occur during the two year legal period of warranty you are entitled to supplementary performance (either removal of defects or replacement) as well as to mitigation, withdrawal or compensation if all legal stipulations are met.

Ordering

When you have found the desired product(s), you can place these item(s) into your Shopping Cart by clicking on the buttons "Order" or "Pre-order". The button [Pre-order] displays in addition to the stock notice that the order can not be shipped immediately. The contents of the basket will  already be displayed in the left column of the shop in short form. Furthermore by clicking on the button "Shopping cart", you may at any time inspect all details of the shopping cart without obligation. Any products in the shopping cart may at any time be dropped again by clicking on the "Remove" button and then on the "Reload page" button. If you want to buy the products in the shopping cart, click the "Order" button. Please then enter your data. Mandatory fields are marked with an asterisk (*). Your data is transmitted in encrypted form. After filling in your data and choosing the method of payment you will go to the order page via button [Check data]. Here you have the possibility of verifying your given data once again. You then finish the order process by clicking the button [Order]. Closing the browser can cease the procedure at all times. You will receive further information on the following pages, i.e. about correction possibilities.


Contractual Text

The contractual text is saved within our internal system. The Standard Business Terms can be consulted on this page anytime. The order data as well as the General Terms & Conditions will be sent to you by Email.
